Advies

NOA Omgeving adviseert over specifieke vraagstukken op het gebied van omgevingsrecht en algemeen bestuursrecht. Het kan gaan om een zeer gerichte vraag (casuïstisch advies), of een heel dossier of project waar advies over wordt uitgebracht. Het kan zo compact of uitgebreid als u zelf wilt. U kunt ook dossiers outsourcen bij NOA Omgeving. Vanaf een afstand wordt aan uw dossiers gewerkt om bijvoorbeeld een achterstand weg te werken. Enkele voorbeelden:

Planvorming & gebiedsontwikkeling

Om een ruimtelijke ontwikkeling mogelijk te maken zijn vaak ruimtelijke plannen nodig zoals bestemmingsplannen of ruimtelijke onderbouwingen voor omgevingsvergunningen. NOA Omgeving werkt samen met specialisten zodat een volledig (bestemmings-)plan kan worden aangeboden (toelichting, planregels, verbeelding, omgevingsonderzoeken). Dit geldt natuurlijk ook voor meer beheersgerichte plannen zoals actualisatiebestemmingsplannen, conserverende bestemmingsplannen en beheersverordeningen. Het opstellen van overeenkomsten voor kostenverhaal maakt ook vaak onderdeel uit van deze planvormen

Vertegenwoordiging in rechte

In het omgevingsrecht gebeurt het maar al te vaak dat besluiten worden aangevochten in bezwaar en beroep. U doet er als bestuursorgaan goed aan om te verschijnen op een zitting. Het voorbereiden van een zitting kost veel tijd en is over het algemeen geen dagelijks werk voor de behandelend ambtenaar. NOA Omgeving kan de procedure voor de bezwarencommissie, rechtbank of Raad van State voor u uit handen nemen. NOA Omgeving bereid de zaak voor, zonodig met de behandelend ambtenaar, en vertegenwoordigt uw organisatie tijdens de zitting.

Om een goede afweging te kunnen maken voor het handelen in de omgeving (bouwen, gebruik, etc.) is duidelijk beleid onmisbaar. NOA Omgeving kan u helpen met het opstellen van beleidsdocumenten zodat niet alleen binnen uw organisatie duidelijk is welke koers u vaart, maar ook voor de buitenwereld.

Handhaving

Handhaving is niet altijd een populair onderwerp. Soms is het voldoende om iemand aan te spreken op een overtreding. In andere gevallen is een officiële aanschrijving nodig en wordt er zelfs geprocedeerd.
